Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law. LifeTrove is not liable for delays, errors, or disputes resulting from payment processing systems. Any claims regarding unauthorized transactions or errors must first be addressed with the payment provider. Any dispute resulting in a chargeback or payment reversal will lead to temporary suspension of your account until resolved. LifeTrove reserves the right to contest invalid chargebacks with proof of service or delivery. LifeTrove makes no warranty that its products are fit for any particular purpose other than that which is expressly stated in the product description.
SECTION 15 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless LifeTrove and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party. SECTION 22- LIFE CIRCLE SUBSCRIPTION TERMS
LifeTrove offers a subscription membership program called Life Circle, which includes a 28-day free trial, followed by recurring billing every 28 days. By enrolling in the Life Circle subscription, you agree to the following terms:
Trial and Billing Terms
The Life Circle subscription begins with a free 28-day trial. After the trial ends, your selected payment method will be automatically charged $34.95 every 28 days (not monthly) unless canceled prior to renewal.
Each billing cycle includes: $34.95 in store credit usable on the LifeTrove VIP Store, and access to exclusive VIP pricing on all eligible products.
No Store Credit Rollover
Store credit expires at the end of each 28-day billing cycle. Unused credit does not roll over and has no cash value. No refunds are given for unused credit.
Account Management
You may pause your subscription at any time via your account dashboard. You may also update your credit card or payment information within your account at any time. Canceling is simple: once logged into your account, cancellation can be completed with one click. Cancelations take effect at the end of the current billing cycle. No partial refunds are issued for mid-cycle cancelations.
Rebilling Authorization
By enrolling, you authorize LifeTrove to charge your payment method every 28 days until you cancel or pause. It is your responsibility to track the start and end of your trial period. We do not guarantee reminder notifications prior to renewal. Failed rebill attempts due to invalid payment information may result in paused access to subscription benefits.
Program Changes and Termination
LifeTrove reserves the right to modify or discontinue the Life Circle program at any time. If the program is discontinued, any unused paid credit will remain valid until the end of the active billing cycle. Failure to monitor your subscription status or trial end date does not entitle you to a refund once a billing has occurred.
SECTION 23 - DISPUTE RESOLUTION; ARBITRATION AND CLASS ACTION WAIVER
Any dispute or claim relating in any way to your use of the Services, purchase of products, or participation in the Life Circle subscription will be resolved through binding arbitration under the rules of the American Arbitration Association (AAA), rather than in court, except that you may assert qualifying claims in small claims court.
YOU AGREE TO WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATIONS.
You agree to resolve any disputes with LifeTrove solely on an individual basis.
The Federal Arbitration Act governs the interpretation and enforcement of this agreement to arbitrate. Judgment on the arbitration award may be entered in any court having jurisdiction.
You also agree that any dispute or claim must be initiated within one (1) year after the event giving rise to the claim occurs. Otherwise, such claim is permanently barred.
SECTION 24 - CHARGEBACK POLICY
By completing a purchase on this website, including enrollment in the Life Circle subscription, you agree to:
Not initiate a chargeback without first contacting LifeTrove at help@mylifetrove.com and giving us an opportunity to resolve the issue.
Only dispute charges that are unauthorized, fraudulent, or in violation of the disclosed billing terms.
Initiating a chargeback without a prior cancellation request or refund inquiry is considered a breach of these Terms and may result in suspension or permanent loss of your access to the Services. We reserve the right to contest chargebacks using order confirmations, tracking information, account activity logs, and billing consent records.
SECTION 25 - FORCE MAJEURE
LifeTrove shall not be liable or responsible for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, embargoes, government orders, supply chain disruptions, courier delays, or failures of the internet or telecommunications.
SECTION 26 – BILLING AUTHORIZATION; PAYMENT RETRIES & POST-PURCHASE OFFERS
Billing Authorization
By submitting your payment information at checkout, you authorize LifeTrove and its designated payment processors to charge the provided payment method for all amounts due in connection with your purchase(s), including, without limitation, one-time product purchases, post-purchase offers, and recurring subscription charges. You represent and warrant that you are the authorized account holder for the payment method provided.
Payment Retries for Declined Transactions
In the event a charge is declined for any reason (including insufficient funds, temporary holds, or card authorization failures), you expressly authorize LifeTrove to re-attempt processing the charge on the same payment method until the charge is successfully captured or the order/subscription is canceled. Payment retries are generally attempted within seven (7) days of the initial decline, but LifeTrove reserves the right to extend retry attempts for a longer period if reasonably necessary to collect amounts due.
During this period, access to subscription benefits, delivery of digital store credit, or fulfillment of physical products may be temporarily suspended until payment is successfully processed.
If the charge is successfully captured during a retry attempt, your order or subscription shall be deemed fully authorized and binding as of the original order date.
If we are unable to successfully process payment after multiple attempts, we reserve the right to cancel or suspend your order, subscription, or access to related services, without further obligation.
Post-Purchase Upsell Transactions
After completing your initial checkout, you may be presented with optional post-purchase upsell offers. If you accept an upsell offer:
You expressly authorize LifeTrove to charge your payment method for the price of the accepted offer in addition to the original transaction.
Each accepted upsell constitutes a separate, valid purchase, subject to these Terms.
If an upsell charge is declined, you authorize LifeTrove to re-attempt the charge under the same retry provisions described above until the payment is successfully captured or the offer is canceled.
Responsibility for Payment
You are solely responsible for ensuring that your payment method is valid, current, and has sufficient funds. You agree not to dispute, reverse, or charge back any successfully processed transaction that was authorized under this Section, including transactions captured on a subsequent retry attempt, unless such transaction was the result of fraud or unauthorized use of your payment method. Any disputes must first be submitted to LifeTrove support at help@mylifetrove.com before initiating a chargeback with your bank or card issuer.
Collection and Remedies
In the event of repeated failed payments or unauthorized chargebacks, LifeTrove reserves the right to:
Suspend or permanently revoke access to your account, subscription, or VIP membership.
Submit documentation of your order, acceptance of terms, and retry authorizations as evidence to contest chargebacks or payment disputes.
Refer unpaid balances to third-party collection agencies and/or pursue legal remedies, including recovery of reasonable attorneys’ fees and costs incurred in enforcing this provision.
